OIKN Regulation No. 10 of 2026 Resets Licensing Services in Nusantara
Regulation of the Head of the Nusantara Capital City Authority Number 10 of 2026 brings together the procedures for business licensing, non-business permits and other licensing-related services in the Nusantara Capital City (IKN). It has been in force since its promulgation on 13 October 2026 and revokes IKN Authority Head Regulation Number 2 of 2024.
For businesses and applicants, the new regulation covers electronic processing, basic requirements such as spatial-use conformity and building approvals, licensing consultations, and specific rules for foreign investment and foreign workers.
Services covered
The regulation groups IKN licensing services into three categories:
- Risk-Based Business Licensing (PBBR): business licences, basic requirements, business licensing without the issuance of basic requirements, licences supporting business activities, and investment facilities. Recommendations relating to foreign-worker use are also processed through the OSS System.
- Non-business permits: including Spatial Utilisation Conformity Approval (KKPR), Environmental Approval (PL), Building Approval (PBG), Certificate of Function Worthiness (SLF), and other permits within the IKN Authority’s remit.
- Other licensing-related services (non-perizinan): recommendations, facilitation, cooperation agreements, identity cards or credentials, certificates, and other services within the Authority’s remit.
Applications are processed through the OSS System or the IKN Authority’s electronic system, depending on the service. The Authority also provides licensing consultations and handles complaints remotely through digital channels or in person.
Foreign investment requirements
Foreign investment (PMA) is categorised as a large-scale business. As a general rule, the minimum investment is more than IDR 10 billion, excluding land and buildings, for each five-digit KBLI business classification at each project location. The regulation sets specific calculation methods for certain sectors, including wholesale trade, food and beverage services, construction services, industry, property, and public electric-vehicle charging stations. The applicable threshold and calculation basis should therefore be checked against the proposed activity and project structure.
For a PMA limited liability company, issued and paid-up capital must be at least IDR 2.5 billion per company, unless other laws and regulations provide otherwise. Businesses must also submit a self-declaration that paid-up capital will remain in the company’s account for at least 12 months, except for asset purchases, building construction and/or operating expenses. Breaching this declaration may result in administrative sanctions.
Spatial and building requirements
The initial KKPR document review takes up to three business days. If corrections are needed, the business has up to five business days to submit them; the regulation also provides for a second review and a further correction opportunity. Assessment takes up to 15 business days after the documents are declared correct. KKPR approval must be issued within 20 business days after the requirements have been received as complete and correct and the non-tax state revenue payment has been made. These periods are working days; the KKPR issuance fee is IDR 0. An application may be rejected if corrections are not submitted on time or are still found to be incorrect.
Planning consultation for a PBG is free of charge. Technical-standard reviews may take place up to five times within a maximum period of 26 days after the documents are declared complete or correct. The tariffs for PBG and SLF are IDR 0.
In the circumstances provided for by the regulation, construction may proceed in parallel with the PBG process based on construction drawings approved by the IKN Authority and accompanied by a construction record issued by the Expert Team for structural matters. As a general rule, an SLF must be obtained before a building is used. It is valid for five years, or 20 years for single or row houses.
Foreign workers
Before submitting a foreign-worker utilisation plan, a business must request a recommendation from the Head of the IKN Authority. The recommendation forms the basis for approval of the plan for 10 years and may be extended in accordance with applicable rules. Businesses employing foreign workers are exempt from the foreign-worker compensation fund payment through 2035.
Other points to note
- For trade and/or service businesses operating in a shared building or complex, the business may use the manager’s or owner’s KKPR, PL, PBG and SLF, subject to the applicable requirements. The IKN Authority must verify the documents within three days. Special rules apply to buildings managed by the IKN Authority or a ministry or agency.
- A business or applicant seeking to use land under the IKN Authority’s management rights must attend a licensing consultation. The consultation produces land-allocation documents, a spatial information package and plot-planning guidance, as well as initial design and building approval. These documents are licensing requirements.
- Pending PBBR, non-business permit and other service applications are processed under Regulation No. 10 of 2026 once it takes effect.
- If the OSS System or another electronic system is unavailable due to force majeure declared by the Head of the IKN Authority, services may be provided manually. Relevant data and documents must be entered into the system once the force majeure has ended.
Effective date
The regulation was enacted in Nusantara on 30 September 2026 and promulgated on 13 October 2026. It took effect on promulgation and revoked IKN Authority Head Regulation Number 2 of 2024. Building owners who already held an IMB or PBG before the new regulation took effect may apply directly for an SLF. Buildings without an IMB or PBG must first apply for a PBG.
